If someone threw a punch at me but missed and i threw one back and broke his eye socket, can he sue me?

Answer:
Anyone can sue you for anything. So, yes. Whether they will win or not, that is the question. As for that...Who knows?
SELF DEFENSE
yep
Yes. That's assault and battery. Find a lawyer. At the least, he can sue for damages (lost work, medical bills), and he can probably get pain and suffering too.
In short, yes.
If the damage is over $20, yes he can...I think it is also depending on what you were fighting for.
I'd agree with the first post. If there are witnesses can prove he swung first, he can sue you but hes just wasting money.
yep! You can sue for someone looking at you wrong (I'm serious here) the question here is will he win a judgment?
that would depend on how well you fight it or more precisely how your lawyer does.
if he threw the first punch i believe it can be looked at as self defense. if he threw one punch that didn't land you have to figure he is gonna throw another one. witnesses are key in these situations
you need to elaborate on this for a real answer. Are you worried more about the eye or the suit or was his eye socket weak or were u being overly punishing or were u defending yourself?
oh yeah and he can also press charges against you also !
uh huh...Only if he were to have a witness to say that you threw the FIRST punch. I say to him.."Good luck with that."
I have read through all the answers%26lt;%26lt;%26lt;My Nephew is a Police Officer, and this is mainly the thing he has to deal with.
You most definatly HAVE to have wittnesess!!Very Good Luck to You On This! 鈾?
not if u say it was self defense and ur life was in danger and u were tryin to save urself...u might need a lawyer though..and whenever in a fight, try not to get the other person blood on u..u never know what dieases they may have and try not to break ur own skin in anyway either...NO HIV CAMPAIGN '07
